Village Rules

The rules of the Village are intended to establish a set of standards that will protect each resident’s investment while providing an enjoyable and friendly lifestyle for all who reside in the Village. The success of the rules of the Village in achieving those objectives depends on reasonable and fair enforcement by the Manager of the Village and each owner’s thoughtful acceptance and adherence to them. The Management will use its discretion in the enforcement of these rules.

1. An owner and members of their family or household and guests, agents and invitees shall not; Use their site for any purpose which may be illegal or injurious to the reputation of the Village or occupiers of other sites or which may interfere with the peaceful enjoyment of another site by occupiers or which may interfere with the general Management of the Village.

Paint, affix or display any signs, advertisements, notices, posters, placards, banners or like matter to or on any part of the villa or the site without the prior consent of the Management.

Permit any auction sale to be conducted or to take place on their site in the Village without the prior approval of Management.

Bring to, do or keep anything on their site which shall increase the rate of fire insurance on the Village or on any property on the site which may conflict with the laws and/or regulations relating to fires or any insurance policy upon the Village or any property on the site or the ordinances of any Public Authority or for the time being in force.

Bring on the site any animals or birds without the consent of the Management.

Make or commit any objectionable noises in the Village or interfere in any way with the peaceful enjoyment of the other occupiers, those having business with them or any person using the common property.

Permit or suffer any person who in the opinion of the Management is of unsound mind or a drunkard to reside in or about the site.

Use the Community Hall, swimming pool or spa outside the hours as determined by Management. Use of these facilities is at user’s risk at all times and Management accept no responsibility for loss of property, or injury occurring during use. Children under the age of 15 must be supervised at all times.

Erect or permit to be erected any garden shed or clothes line without the specific permission in writing from the Management.

Paint or modify any part of the external Villa except as approved by Management.

Store any flammable chemical, liquid, gas or other flammable material other than used or intended to be used for domestic purposes.

Use as a garden any part of the Village outside their site without prior approval from Management.

2. An owner and members of their family or household and their guests, agents and invitees shall;
Give Management prompt notice of any accident to or defect in the community common area water pipes, electrical installation or fixtures which comes to their knowledge and the Management shall have authority by agents or servants in circumstances having regard to the urgency to examine or make such repairs or renovations as they may deem necessary for the safety and preservation of the Village as often as necessary.

Keep their site clean and take all practical steps to prevent infestation by vermin and/or insects.

Empty bottles, boxes, used containers and similar items are to be stored tidily and so far as possible out of sight. In the event of illness, absence or incapacity, and unable to look after their gardens, Management, upon request, may ensure adequate gardening maintenance at a reasonable cost.

Keep windows clean and promptly replaced at owner’s expense with the same material if broken or cracked.

Observe the terms of any notice displayed by Management or of any Statutory authority.

Place all household rubbish and food scraps in plastic liners and keep in a clean and odourless condition in the wheelie bin provided. Burning rubbish is not permitted on site.

Management reserves the right, and that of its servants, agents or contractors, to access any villa, in the event of an emergency, to inspect and test any electrical, gas or water installation or equipment therein and to trace and repair any leakage or defect in the said installation or equipment (at the owner’s expense).

Owners are responsible to ensure that a nominated third party has keys to the villa for emergency use during any prolonged absence, and that the third party’s contact details are provided to Management in such an event.

All routine maintenance is the responsibility of the villa owner after the initial six month warranty period has expired.

No child, servant or guest of the owner shall be permitted to cause any annoyance to other owners. All visiting children are to be supervised by the owner especially around the pool, Community Hall and common areas. The owner shall give an undertaking that they will be responsible for the welfare and safety of any visiting children. No children’s bikes, skates, skate boards etc. are to be used on the Village roads or car parks.

Storage of motor vehicles or the effecting of mechanical repairs to motor vehicles shall not be permitted on the site.

A speed of 10kph for vehicles within the confines of the Village will be strictly observed.

Owners will inform their guests that any visitors’ cars are parked in areas as designated by Management and not on roadways; and, that visitor’s cars enter and park in the Village at their own risk.

Owners have first preference of use of any Village facility. Visiting guests are to be accompanied by an owner when using the facilities.

Owners have the responsibility to ensure all guests and invitees comply with these Village Rules.

3. Occupancy of the Villas
No person whether an owner or not shall be entitled to occupy or reside in, on or upon a site unless that person shall be at least fifty (50) years of age or be married to or living in a defacto relationship with a person who is at least fifty (50) years of age and now is usually occupying or residing in, on or upon the residence.

Any person not being a person referred to in the above shall be entitled to stay in a site as a guest of the owner provided the stay does not exceed four (4) weeks in any twelve month period. However, the Management may at its discretion on request in writing of an owner who is at least 50 years of age grant permission for an extension of this period for a person acting as carer or where special circumstances apply. Management may withdraw the extension of this period and notify the owner accordingly.

The villa is for owner occupation and shall not be rented or sub-let at any time.

4. Pets
Small dogs and/or cats are permitted at Twin Cedars. All pets must be properly controlled and looked after. Dogs and cats must be de-sexed.

Dogs must not be allowed outside the owner's site unless on a leash. Droppings must be picked up and disposed of by the person in control of the dog. Cats cannot be allowed to roam freely, especially at night.

A pet, which is lost or has died, cannot be replaced without permission from the Management.

5. Fencing and Driveways
Fencing and driveways are the responsibility of the site owner.  Villa fences are to be no higher than 1.2m.

6. Caravan Storage
All caravans are to be stored in the designated caravan storage area unless specific permission has been granted by Management for alternative locations.

Caravans belonging to residents will be stored at no charge. All other caravans will be charged a fee as set by Management.

All caravans, and their contents, are stored in the Village at the owner’s risk.

7. Utilities and Services

Water:  An entitlement of up to 13kl of water per month is included in the site fee.  Any amount over this is considered excess water consumption and will be invoiced monthly to the resident.  Water used up to 13kl is non-accruable and cannot be offset against site fees. The resident acknowledges that conservation of water is an important factor to the Village economy.  The resident will immediately notify Management of any damage, defect or disrepair in the water service on site.

Gas: Not included – Supply on site

Electricity: Not included

Telephone: Not included

Villa Gardens:  Weeding lawns and maintenance of individual Villa gardens is the responsibility of the owner, including top dressing, drainage etc… Villa lawns will be mowed up to twice per month at no charge. For additional mowing a fee of $10 will be charged.  Water issues that are caused from outside the Villa garden (i.e. storm water runoff)  will be assessed by Management and  necessary action to rectify will be taken.

Gutters: If gutters require cleaning, this can be arranged at owner’s expense, charged on an hourly rate.

Lost keys: Owners are responsible for the cost of replacing lost remote control, letterbox or gate keys.

8. Security
Security gate control is installed to all villas.  Early advice to Management of any trespassing, vandalism or neglect of Village premises will be appreciated.

9. Village Environment
Villas must not be used for any purpose which is illegal or interferes with the “peaceful” enjoyment of neighbours.  Carrying out trade activities, vehicle repairs, or excessive use of power tools enter into the category.

Do not park or allow visitors to park any motor vehicle in locations other than those provided for parking.  Do not allow any vehicles to be parked in any roadway in the Village.

10. Village Rules
The owner of Twin Cedar Lifestyle Village may introduce new Village rules from time to time. The Management of the Village will enforce the conduct of persons anywhere in the Village to ensure the legal right of all residents to a “quiet enjoyment.”

11. Complaints Procedure
As a policy, Management prefers complaints to be handled on a personal basis and as quickly and efficiently as possible. Complaints are to be made in writing and submitted to the Management.

12. Site Fees
Site fees are payable and are regulated as per Section 7 of the Manufactured Homes (Residential Parks) Act 2003 - Form 1. Site fees are a combination of land rent, land and water rates, upkeep of the community streets and community areas, community electricity, operation of the security entry system, maintenance of the swimming pool, Community Hall, gardens and tracks, BBQ areas, management and administration.

There are no body corporate fees, special levies, or any other charges. Owners are responsible to pay own household insurance, power, telephone, gas and excess water.

The site fee is $128.00 per week  (effective 1 July 2011) and is reviewed annually (each July) in accordance with inflation and written notice of one (1) calendar month will be given of a rent increase. The site fees are GST inclusive.

The owner is required to pay site fees, and other charges, by due dates. In the event that the fees become overdue, Twin Cedars Management reserves the right to apply to the Commercial and Consumer Tribunal for orders to affect collection of the outstanding monies.

Five Yearly Market Reviews
Market reviews will be conducted at five yearly intervals, commencing from1 July 2006, to reflect the market, replacing, but not in addition to, CPI and/or rates and utility increases due and payable in the intermediate years.

At no time shall the site rent at five yearly market review be less than the site rent for the previous year.

Five yearly intervals shall commence from the 1st July 2006 and shall occur only on years that end with 6 or a 1 i.e. 2011, 2016 etc.

13. Office Hours
Office hours are 9am-5pm, Monday to Friday.

Twin Cedars Management reserve the right to change the Village Rules from time to time. Dated: June 2011
